During 2023, a project was carried out in which various legal requirements for biocidal products that are authorised according to the Biocidal Product Regulation (BPR) were checked.
Terms and conditions for these kinds of products are presented in a summary of biocidal product characteristics (SPC). The labelling of the biocidal product shall reflect the information in the SPC. In the project, the labelling of the products was checked to ensure that it reflected the information in the SPC. In the project we also checked if the labels contained any misleading information and that the supplier of the active substance was included in the so-called article 95-list. The project focused on biocidal products in product type 14 (rodenticides, 18 (insecticides) and 19 (Attractants and repellents). In total 34 biocidal products authorised for the Swedish market were controlled at 22 authorisation holders or agents, both in Sweden and in other member stated in the EU.
The results of the project showed that:

There were no non-compliances regarding Article 95, the supplier of the active substance was found on the so-called Article 95 list.
•
Only 4 of the inspected products had non-compliances regarding CLP-labeling, all of which were concluded to be less serious non-compliances.
•
The majority of the inspected products (80 %) had some non-compliances regarding the specific biocidal labelling, which were in most cases considered minor.
•
The most common non-compliances regarding the specific biocidal labelling were that the active substance had not been specified correctly, incomplete first-aid information and incomplete instruction of use.
•
Three products had misleading information on their labels.
•
Only two products had non-compliances that would lead to that a notification of suspected crime was sent to prosecutor if the authorisation holder would have been Swedish.
