Products Register

Once a year companies registered in the Products Register have to provide information on their product quantities for the preceding year through the receipt list. They have also to discontinue product reports and file new product reports, and revise information on chemical compositions, if appropriate. The annual chemical charge is based on the information on quantity and number of products.

The legal provisions are contained in Chapter 3 of the Swedish Chemical Agency's (KemI) Chemical Products and Biotechnical Organisms Regulations (KIFS 2008:2).

KemI is authorised to issue an environmental sanction charge for companies that do not submit the required information in time.  Provisions on environmental sanction charges are contained in the Environmental Sanction Charges Ordinance (1998:50).

Companies intending to start an operation in Sweden involving manufacture or import of chemicals are obliged to report this. Any company manufacturing, importing or changing names of chemical products to the minimum amount of 100 kg must file a product report to KemI. The information contained in the register has been submitted by companies reporting data on approximately 145 000 chemical products.

An enterprise may also obtain a permission to make a product report on behalf of its customer.

Information contained in KemI´s chemical products register is used to support supervisory activities and make it possible to gain an overview of the chemical products used in Sweden. However, other authorities, researchers, various organisations and the general public also request the information in the register. In all cases a confidentiality evaluation is performed on a case-by-case basis before any information is handed out.

Information on the contents of single products cannot be provided. Such information can only be requested from the manufacturer or the importer of the product into Sweden.

Secrecy legislation

Regulations on secrecy applicable to the Swedish Chemicals Agency are contained in the Public Access and Secrecy Act (2009:400) and Ordinance (2009:641).

One of Sweden’s constitutional laws, the Freedom of the Press Act, states the fundamental principles of public access to official documents and secrecy. According to this Act, the extent to which secrecy applies is to be regulated solely by the Secrecy Act and Ordinance. It is therefore not possible for the Swedish Chemicals Agency to make any commitments not to communicate the information submitted to the Products Register, for example by signing a secrecy agreement.
